Limitations: Implied warranties including those of fitness for a particular purpose and merchantability are limited to the period the first purchaser owns the product. We are not liable for time lost, inconvenience and loss of use of your Chocolate Fountain or property damage caused by failure to operate or any incidental or consequential damage. 

Payments by credit card for commercial fountains and  wholesale purchases are subject to a surcharge

Terms & Conditions for Machine Only Hire Options

1.     The equipment must be operated as explained on the Instructions for use.

2.     No liquid other than those specified in the instruction manual can be added to the fountain.

3.     Under no circumstances must the base of the fountain be submerged in water.

4.     The Hirer will return all the equipment to Bury & Bean Ltd, on the agreed date in the same condition as when it was received and in the packaging provided.

5.     The Hirer will be responsible for any damage up to and in excess of the value of £500.00 however caused while in the hirers’ possession.

6.     The hirer is responsible for theft of the rented equipment to the full value of each item.

7.     In the event of default in the payment of any amount due to The Chocolate Fondue Company under the terms of this agreement and if this account is placed in the hands of an agency or solicitor for collection or legal action, the Hirer aggress to pay in addition to the amount due hereunder all costs of collection including agency and solicitors fees and court fees.

8.     The Hirer shall have exclusive possession control and use of the equipment for the entire period of this Agreement and the Hirer shall completely assume full responsibility to the public and any regulatory body having jurisdiction. 

9.     The hirer undertakes to use the equipment in a skilful and careful manner at all times.   

Courier delivery and collection1.    

1.    The items must be checked on receipt and any damage brought to the notice of the courier immediately.  This must then be noted on the delivery documents and you must notify Bury and Bean Ltd by calling the office on 0800 8818899/01376 584669 on the day of receipt.  Once signed and accepted from the courier, you are responsible for any damage up to and in excess of the value of £500.00 however caused.

2.     The items must cleaned, placed in the containers provided and be ready for collection on the day of return from 2.00pm to 5.00pm unless otherwise stated.

3.  The items will be checked upon receipt at our address and once cleared the deposit will be refunded.  This can take up to seven days. 

Please note:- There will be a penalty should the fountain not be available for collection or returned to our head office on the date agreed.  This will be the equivalent of 1 days hire i.e. £99 +VAT plus any costs levied by the courier. 

Payment and Cancellation 

Full payment is required on receipt of the booking form.  A booking confirmation letter will then be sent.   Should you wish to cancel the booking an 80% refund will be given as long as more than seven working days notice is given in writing either by letter or email (info@chocolatefonduecompany.co.uk).   Should you cancel within seven working days of the hire date, no refund will be given. (Working days are Monday to Friday) 

Acceptance of Terms & Conditions of Hire: 

The Customer acknowledges that the company is entitled to charge any credit or debit card nominated at the time of rental for any charges due to the company in pursuit of this agreement. Bury & Bean Ltd trading as The Chocolate Fondue Company cannot be held responsible for any injury caused by misuse of the equipment by the hirer or any of their guests. 

The equipment remains the property of Bury & Bean Ltd at all times.
